Maintenance of Effort (MOE) Waiver Request
As required by the 2011-13 state budget, the Department
will submit a proposed Demonstration Project under section 1115 to waive
the Maintenance of Effort (MOE) Waiver requirements established under
the Patient Protection and Affordable Care Act (PPACA). As outlined in
the state budget, if the Department does not receive approval of the
waiver request before December 31, 2011, the Department is required to
reduce income eligibility for non-disabled, non-pregnant adults to 133%
of the Federal Poverty Level (FPL), as allowed under federal law. Based
on August 2011 caseloads, PPACA authorizes the state to dis-enroll
53,161 individuals (47,125 BadgerCare Plus parents and 6,036 BadgerCare
Plus Core enrollees).
