Invitation to Wisconsin Counties and Tribes to a Meeting to Discuss Changes To 1915(i), Community Recovery Services, stemming from the Patient Protection and Affordable Care Act of 2010 (PPACA).
This document serves as an invitation to Wisconsin Counties and Tribes to meet with Division of Mental Health and Substance Abuse Services (DMHSAS) leadership and staff on May 25th, 2010 in Madison to discuss the implications to the 1915(i) Community Recovery Services Medicaid state plan benefit as a result of the recently passed federal PPACA. This Numbered Memo further serves to reiterate the Division’s earlier email communication regarding this meeting that was sent specifically to Wisconsin’s Counties and Tribes.
The Department has learned that there are two major provisions in the PPACA that impact Wisconsin’s 1915(i) services. The first is the elimination of the option to limit the number of eligible individuals. States will no longer be able to establish wait lists. States continue to have the ability to change functional eligibility criteria and control the numbers of people who are eligible for a discrete and distinct number of services. The second change is the elimination of the option to waive state-wideness. Originally, a state could designate certain geographic areas as participating. Now, as with other Medicaid programs, 1915(i) services must be offered on a state-wide basis. There is an additional provision that allows states to offer services to a specific targeted population. This provision has a five year phase-in period that Wisconsin might be able to use.
Wisconsin’s 1915(i) State Plan Amendment, when approved, is effective January 15, 2010 under the old rules. Changes stemming from the PPACA become effective on October 1, 2010, and Wisconsin’s State Plan will need to be revised later this year to comply with those changes.
All Wisconsin Counties and Tribes Meeting Planned
The Department is inviting all Wisconsin counties and tribes to attend a special meeting to determine the strategic direction of the 1915(i) Community Recovery Services State Plan Benefit. This meeting is not limited to those counties who have indicated that they will be providing 1915(i) services. We are seeking a broader discussion and creative ideas. The meeting details are as follows:
