Re:
Repeal of Chapter HFS 61.50-61.68 and creation of Chapter HFS 75
Administration Rule for Community Substance Abuse Services Standards (Replaces DCS 83-11).
This memorandum serves to provide further information on changes
in the community substance abuse services standards, referenced in
Chapter HFS 75, which replaced HFS 61.50-61.68 and was effective
August 1, 2000. The new standards are being phased in to allow
Substance Abuse Services that are presently certified under sections
61.50 to 61.68 to operate under those standards until their
re-certification visit. At that time, they will need to be in
compliance with HFS 75. We understand that in some instances
providers may need additional time to come into compliance with HFS
75. I such instances, a service seeking re-certification may be
certified provisionally in most cases for up to one year under HFS
75 until full compliance can be met. The purpose for Administrative
Rule HFS 75 is to assure quality of care and continuity of care to
persons receiving substance abuse services, and to serve as minimum
standards in guiding providers of substance abuse services in the
delivery of prevention and treatment services. This communication is
sent to all certified substance abuse services providers and to
providers who seek to be certified under this rule. You may request

Exhibit #1
Is a chart that is provided to assist you in finding specific sections
in the new rule by presenting a side-by-side crosswalk between the repealed
Chapter 61.50-61.68 and the new HFS 75.
Exhibit #2
Is a summary of the major provisions of HFS 75 that describes the key areas
contained in the new rule. Exhibit # 2 references Form MD #HFS 75.02 (39) &
(63) required to be completed by the agency's medical director, physician or
service physician, and Form CS #HFS 75.02 (11) to be completed by agency staff
who are performing or seek to perform clinical supervisor functions. These forms
are to be obtained from the Bureau of Quality Assurance, Program Certification
Unit referenced in Exhibit #3.
Exhibit #3
Lists staff available for technical assistance and certification of services
under HFS 75.
To be certified as a clinical supervisor under the "grandfather"
provisions of HFS 75.02 (11) (f), any person who meets the stated requirements
may apply to the Wisconsin Certification Board (WCB), Inc. to become a certified
clinical supervisor-grandfather (CCS-G). Address: Wisconsin Certification Board (WCB), Inc.,
1233 N. Mayfair Rd., Wauwatosa, WI 53226 and/or Phone # (414) 774-7729. The
WCB will send a clinical supervisor application packet with a fee schedule to
the applicant. If an applicant is denied certification under HFS 75.02
(11) (f) by WCB, the denied applicant can appeal to the Bureau of Substance
Abuse Services Appeals Committee, which will review the applicant’s case and
make a binding decision to either uphold or reverse WCB's decision. The
committee will notify WCB and the applicant of its decision.
