Enforcement Action

The authority and purpose for all EMS laws and administrative rules in Wisconsin is to protect members of the public who require emergency medical care in prehospital or interfacility settings by establishing standards for licensing and operations of ambulance service providers; standard for licensing emergency medical technicians; standards for certifying centers to provide EMS training and for approving training courses and instructor-coordinators.

Enforcement of the statutes and rules, or actions, can take many forms. The department may deny, refuse to renew, suspend or revoke any license, training permit, certificate or approval previously granted, issue reprimands and/or warnings or provide technical assistance in an effort to remediate the issue(s) or problem(s). 

The information in this section is intended to provide public notice of such action taken by the Wisconsin Department of Health Services and the Bureau of Communicable Disease and Emergency Response. A list of such actions follows.

Unlicensed practice - cease order December 1, 2008 First Responder group ordered to cease providing first responder service without a license.
Conditional license issued August 18, 2008 EMT license issued with conditions based on past conviction history.
Reprimand issued July 29, 2008 Intermediate Technician reprimanded for allowing an EMT-basic to function outside the scope of his/her practice, for incomplete and false patient care records, for transporting a patient to an unapproved facility in violation of the service's operational plan and for failure to complete and appropriate patient care report.
License denied July 15, 2008 EMT-basic license denied based on a substantially related conviction for possession of illegally obtained prescription drug in violation of s. 450.11(7)(h), stats. on January 28, 2008.
Conditional license issued April 17, 2008 First responder license issued with conditions based on past conviction history.
Conditional license issued April 15, 2008 EMT-basic license issued with conditions based on past conviction history.
Conditional licensed issued April 10, 2008 EMT-basic training permit issued with conditions based on past conviction history.
License revoked March 27, 2008 First responder license revoked for failure to report conviction history.
License denied March 13, 2008 EMT-basic license denied due to substantially related conviction history for carrying a concealed weapon, in violation of s. 941.23, stats, on April 26, 2000; for Disorderly conduct - Use of a Dangerous Weapon, in violation of s. 947.02, stats, on July 17, 2006; and for Disorderly Conduct While Armed, in violation of s. 947.01, stats, January 15, 2008.
Reprimand issued January 3, 2008 EMT-paramedic reprimanded for failure to assure a legal crew when transporting a patient, for failure to complete a timely patient care report and for failure to comply with the services' approved operational plan.
Cease and desist issued December 27, 2007 Cease and desist order issued to a fire department that was providing emergency medical responder services that was not licensed as a first responder organization.
Instructor/coordinator certification suspended December 21, 2007 Instructor/coordinator certification suspended for failure to adhere to the requirements under HFS 110.07, Wis. Admin. Code, Sec. HFS 110.07(3)(c)(4).
License revoked December 7, 2007 EMT-Intermediate Technician license revoked for a substantially related conviction for Mail Fraud, a Class C felony, in violation of 18 U.S.C. 1341, on November 1, 2007.
License renewal denied December 7, 2007 EMT-basic license renewal denied for a substantially related conviction for two counts of disorderly conduct, in violation of Wis. Stat., 947.01, on October 31, 2007.
Reprimands issued December 4, 2007 Issued  reprimands to two (2) former service directors for failure to comply with staffing regulations.
Warning letters issued November 20, 2007 Issued warning letters to four (4) EMT-Basic trainees who participated in patient care (including performing advanced skills) with no EMT supervision and who participated in illegal crews.
Warning letter issued November 20, 2007 Issued a warning letter to an unlicensed individual who participated in patient care, who participated in a call or calls wherein unsupervised individuals with training permits and/or no EMT license(s) were allowed to provide patient care (including advanced skills) and who participated in a illegal crew.
Warning letter issued November 20, 2007 Issued a warning letter to an EMT-Basic who participated in a call or calls wherein unsupervised individuals with training permits and/or no EMT license(s) were allowed to provide patient care and who participated in a illegal crew.
Warning letters issued November 20, 2007 Issued warning letters to three (3) EMTs-Basic who participated in allowing unlicensed individuals to provide patient care (including advanced skills) and who participated in illegal crews.
Warning letters issued November 20, 2007 Issued warning letters to two (2) unlicensed individuals who participated in patient care  and who participated in illegal crews.
Warning letters issued November 12, 2007 Issued warning letters to two (2) EMTs-Intermediate who acted outside the scope of practice of their license by treating a patient then releasing him without transporting to the emergency department for evaluation. The service which they were affiliated did not have treat and release protocols for the treatment rendered.
Revoked first responder certificate and training permit November 7, 2007 Revoked the First Responder certificate and EMT-Basic training permit for failure to report convictions that substantially relates to the practice of a First Responder and EMT-Basic trainee.
Case and desist order November 7, 2007 Cease and desist order issued to an individual operating and advertising as an ambulance service without a license.
License denied October 10, 2007 EMT-basic license denied for a substantially related conviction for Possess illegally obtained prescription drug in violation of s. 450.11(7)(h), stats, possess illegally obtained prescription drug in violation of s. 450.11(7)(h), stats, and theft-movable property <+ $2500 in violation of s. 943.20(1)(a), stats, on November 28, 2006.
Revoked license and denied training permit October 8, 2007 and October 12, 2007 EMT-basic license revoked and IT training permit denied after applicant was found to have intentionally submitted false documentation and forged the signatures of at least two preceptors in an attempt to verify the completion of supervised field experience while enrolled in a paramedic program.
License revoked August 21, 2007 EMT-basic license revoked after the EMT was found to have intentionally submitted an altered license from another state to a Wisconsin service also licensed in that other state in an attempt to verify current licensure when, in fact, that license had expired.
Warning letter issued July 3, 2007 Issued a warning letter to an EMT-intermediate technician student who started an IV on a minor child without medical direction or supervision.
License revoked June 15, 2007 Revoked the license of an EMT-paramedic due to a substantially related conviction history. The EMT was convicted of possession of narcotics and theft of moveable property after the EMT admitted to taking medications from the ambulance in which he/she was working.
License revoked May 17, 2007 Revoked the license of an EMT-basic for submitting fraudulent documentation of refresher training, in violation of sec. 146.50, Stats, and sec. HFS 110.09(1)(c), Wis. Admin. Code.
Training permit denied May 14, 2007 Denied the training permit application of an individual with a substantially related conviction history for disorderly conduct and negligent mistreatment of animals and for failure to comply with probation.
First responder certificate denied May 4, 2007 Denied a first responder certificate due to the applicant's substantially related conviction history. The applicant had a history of 5 OWI convictions. The applicant appealed this decision so a hearing was held before an administrative law judge on September 17, 2007, who upheld the department's denial of the first responder certificate.
License denied April 26, 2007 EMT-basic license renewal denied for a substantially related conviction for OWI (4th) offense while under a stipulation to commit no further violations of law.
