Statewide Transition Plan
Request for Public Comments
The Wisconsin Department of Health Services operates several programs
under federal authority from the Centers for Medicare and Medicaid
Services (CMS) Medicaid Home and Community-Based Services (HCBS)
waivers. Waivers give states options to provide Medicaid services in
home and community-based settings. In 2014, CMS published new
regulations that changed the definition of HCBS settings in its waivers.
The regulations ensure that Medicaid long-term care programs provide
full access to the benefits of community living and offer services in
the most integrated settings. The state must submit a statewide
transition plan that identifies how it will come into compliance with
the new outcome-oriented definition of HCBS settings by March 17, 2019.

The Department is seeking comments on the draft five-year statewide
transition plan for all waiver programs covered by the CMS regulations.
Note: DHS is waiting for further guidance from CMS regarding the
interpretation of the regulations as they pertain to settings for day
services. The draft document is subject to change pending receipt of CMS
guidance and public comments.
