The purpose of this memorandum is to provide you with information related to:

  • Wisconsin Administrative Code HFS 133

  • Home health agency questions and answers

  • Potential impact of the home health prospective payment system (HHPPS)

Wisconsin Administrative Code HFS 133 Revisions

Revisions to Chapter HFS 133, Wisconsin Administrative Code for home health licensure, became effective on May 1, 2001. The Bureau of Quality Assurance (BQA) will begin surveying for compliance with the revised HFS 133 beginning on July 1, 2001. A copy of the revised rule (exit DHFS), dated April 2001 is attached. The following areas of HFS 133 have been revised:

  • HFS 133.02 (5m), (6g), (6m), (8m), and (12m), Definitions

  • HFS 133.03 ((3)(h), Application, (4)(b), (4)(c),and (4)(d), Issuance of license, (8), Hearings, (9), Reporting

  • HFS 133.04(4), Inspections

  • HFS 133.06(4)(d)1, Employee health

  • HFS 133.09 (3), Discharge of patients.

  • HFS 133.10(1), Required services

  • HFS 133.14(6), Contracted registered nursing services

  • HFS 133.20(4), Physician’s orders

Home Health Agency Questions and Answers

BQA received the attached memorandum, ref. S&C 01-14, dated April 23, 2001, from the Health Care Financing Administration (HCFA), Survey and Certification Group. The memo provides guidance on the home health issues listed below to HCFA regional office and state agency survey and certification personnel.

  • 42CFR 484.4 - Personnel qualifications

  • 42CFR 484.10 - Patient rights

  • 42CFR 484.14 - Organization, services and administration

  • 42CFR 484.16 - Group of professional personnel

  • 42CFR 484.18 - Acceptance of patients, plan of care and medical supervision

The information included within this memorandum is currently in effect and provided as clarification to current HCFA policy.

Potential Impact of the Home Health PPS

BQA received the attached memorandum, Ref. S&C 01-15 (exit DHFS; PDF), dated April 30, 2001, from the HCFA, Survey and Certification Group. The memo provides information on the topics listed below to regional office and state agency survey and certification personnel. HHAs may find the review of these current policies useful.
