Revised Wisconsin Administrative Code, Chapter DHS 83, Effective April 1, 2009

On April 1, 2009, the Department will implement its revised Wisconsin Administrative Code, ch. DHS 83, regulating community-based residential facilities (CBRFs). The new requirements may be found at the following link

This memo provides important information about the following:

    Chapter DHS 83 was published in the Wisconsin administrative register on December 31, 2008, and will become effective April 1, 2009. On April 1, 2009, providers will be expected to be in compliance with the new requirements. The Department will use reasonable regulatory action in complying with its mandate to assure that the health, safety, and welfare of residents in CBRFs are protected and safeguarded.


    Beginning March 10, 2009, the Bureau of Assisted Living will offer free training to CBRF providers and caregivers through a series of webcasts. This training will be provided in four (4) one-hour modules. The webcasts will be available on and after March 10, 2009, and may be found on the DQA Provider Training page located at:

    Guideline of Changes

    Attachment 1, entitled "Guideline of DHS 83 Rule Changes," provides an outline of the areas of change for Wis. Admin. Code ch. DHS 83. The guideline does not include all of the changes effective in the new rule. Furthermore, the guideline does not include the entire area of change or state the exact rule language. NOTE: It is the responsibility of each provider to review and become familiar with the specific language and requirements that are identified in the newly revised chapter DHS 83.
