Revisions to Chapter HFS 132, Wisconsin Administrative
Code, effective September 4, 2007
On September 1, 2007, significant changes to Chapter HFS 132, Wisconsin
Administrative Code took effect.
The revisions were developed by staff from the Division of Quality
Assurance (DQA) in collaboration with representatives from the Board on
Aging and Long Term Care, Disability Rights Wisconsin, Inc., and Wisconsin
nursing home associations.
The revised Chapter HFS 132 eliminates rules that were outdated or overly
prescriptive, or were essentially duplicated in Chapter 50, Wisconsin
Statutes, or in the Wisconsin Commercial Building Code or federal nursing
home regulations at 42 CFR 483.
These changes reduce the number of requirements in HFS 132 by almost 50
percent. Facilities continue to be responsible for being in compliance with
Chapter 50, the Wisconsin Commercial Building Code, and, if certified for
Medicaid or Medicare, with the federal nursing home regulations.
Two important additions were made to the code. Section HFS 132.16 creates
a Quality Assurance and Improvement Committee composed of representatives
from nursing homes, advocates, staff from the Department, and
representatives from other interested organizations.
The committee will distribute funds to facilities that have submitted
innovative, cost effective proposals for improving the operation of a
nursing home and the quality of life for residents. Additional information
about how to apply for these funds will be available on the DQA internet
site in the near future.
Section HFS 132.14 (4) (b) was amended to require applicants for nursing
home licensure to disclose information to the department regarding past
regulatory compliance and financial history in the operation of a health
care facility.
The following DQA memorandums have been updated to be consistent with the
revised code and will be available on the DQA internet site shortly.

The DQA memorandum listed below has been rescinded.

Other memorandums pertaining to Chapter HFS 132 will be reviewed and
addressed in the future.
