Delayed Implementation of Sprinkler System Requirements for Small Class C Community Based Residential Facilities (CBRFs)

The purpose of this memorandum is to remind small Class C CBRF providers that by April 1, 2014, all Class C CBRFs shall have installed a complete automatic sprinkler system as required by DHS 83.48(8), Wisconsin Administrative Code.

On April 1, 2009, revised Chapter DHS 83 for Community Based Residential Facilities was implemented. In this revision, DHS 83.49(2) exempted small Class CA, small Class CS and small Class CNA facilities constructed and licensed before April 1, 2009, from the sprinkler system requirements under DHS 83.48(8) if alternative requirements were met. However, DHS 83.49(1) requires that CBRFs using the exemption under sub. (2) have a complete sprinkler system as required under DHS 83.48(8) within 5 years of April 1, 2009.

All small Class C facilities that do not have a complete sprinkler system must continue to meet the alternative requirements to a sprinkler system in accordance with DHS 83.49(2)(a)-(g) until a complete sprinkler system is installed per DHS 83.48(8). See DHS 83.48(8) to determine the type of complete sprinkler system that must be installed depending on how the facility is constructed.
