Delayed Implementation of Sprinkler System Requirements for Small Class C Community Based Residential Facilities (CBRFs)The purpose of this memorandum is to remind small Class C CBRF providers that by April 1, 2014, all Class C CBRFs shall have installed a complete automatic sprinkler system as required by § DHS 83.48(8), Wisconsin Administrative Code. On April 1, 2009, revised Chapter DHS 83 for Community Based Residential Facilities was implemented. In this revision, § DHS 83.49(2) exempted small Class CA, small Class CS and small Class CNA facilities constructed and licensed before April 1, 2009, from the sprinkler system requirements under § DHS 83.48(8) if alternative requirements were met. However, § DHS 83.49(1) requires that CBRFs using the exemption under sub. (2) have a complete sprinkler system as required under § DHS 83.48(8) within 5 years of April 1, 2009. All small Class C facilities that do not have a complete sprinkler system must continue to meet the alternative requirements to a sprinkler system in accordance with § DHS 83.49(2)(a)-(g) until a complete sprinkler system is installed per § DHS 83.48(8). See § DHS 83.48(8) to determine the type of complete sprinkler system that must be installed depending on how the facility is constructed.
