Revisions to Chapters DHS 83 Community Based Residential
Facilities and DHS 88 Licensed Adult Family Homes - Effective January 1,
2011
The Division of Quality Assurance (DQA) Omnibus rule, amending certain
provisions in DHS 83 and DHS 88, takes effect January 1, 2011. The
administrative rules were amended to correct cross references, links and
charts and to make other minor changes. A summary of the changes made to
each rule is listed below. The complete text of Chapters DHS 83 and DHS 88

Wisconsin Administrative Code Chapter DHS 83
- DHS 83.15 (1) (c) and (d) were amended to allow the assisted living
administrator's training course to be approved by the Department's
designee in addition to the Department.
- DHS 83.35 (1) was amended to clarify that the facility is required to
complete an assessment when there is a change in the resident's needs,
abilities or condition or at least annually.
- DHS 83.38 (1) (g) 1. was amended to permit an advanced practice nurse
as defined in s. N 8.02 (1) to complete the annual physical health
examination of residents.
- DHS 83.59 (2) (e) which required 2-way hardware on toilet room doors
that swing into a toilet room was repealed.
- DHS 83.50 (2) (a) 3. was amended to include vinyl, metal and wood in
the definition of construction type VB.
- Appendix A, which shows the Bureau Assisted Living regional offices
with contact information, was updated.
The statewide waiver of DHS 83.59 (2) (e) regarding toilet room doors
issued in DQA Memo 09-031 is no longer necessary and has been rescinded.
Wisconsin Administrative Code Chapter DHS 88
- 2007 Wisconsin Act 20 repealed Wis. Stats., §§ 50.033 (2r), (2s) and
(2t), making the provisions in DHS 88.06 (1) (a) 4. and (4) to provide
information and referral to the aging and disability resource centers (ADRC)
no longer valid. The statewide waiver of these requirements issued by
the Division of Quality Assurance in DQA Memo 08-019 remains in effect.
DHS 88.06 (1) (a) 4. was repealed in this rule, however, DHS 88.06 (4)
was inadvertently dropped from the final rule draft. DHS 88.06 (4) will
be repealed in 2011.
- Appendix A, which shows the Bureau Assisted Living regional offices
with contact information, was updated.
