This memorandum outlines changes in the licensing fee structure for Adult
Family Homes (AFHs) consistent with the enactment of the state budget bill,
Wisconsin Act 28, that became effective June 29, 2009.
Section 1393 of Wisconsin Act 28 amended § 50.033(2), Wis. Stats, to
read (in part):
§ 50.033(2) "The biennial licensure fee for a licensed adult
family home is $171, except that the department may, by rule, increase the
amount of the fee. The fee is payable to the county department under §
46.215, 46.22, 46.23, 51.42 or 51.437, if the county department licenses
the adult family home under sub. (1m)(b), and is payable to the
department, on a schedule determined by the department if the department
licenses the adult family home under sub. (1m)(b)."
Note that there is no additional "per resident" fee.
The Department of Health Services will implement the new biennial
licensing fees on October 1, 2009. The fees will apply to
regularly scheduled license continuations and to new license applications.
When continuations are due, AFHs will receive advance notice from the
appropriate Bureau of Assisted Living regional office. This notice will
reflect the new license fees.
