Methadone Maintenance Information and Update
It is critical that all methadone treatment programs remain in compliance with all federal and state regulatory guidelines. In this regard, it is important
that programs are certain of making proper clinical decisions in determining take-home medication. Currently, a number of initiatives have been taking
place at the federal level.
- The Drug Enforcement Administration (DEA) has regulatory authority in methadone oversight.
- The DEA issued an Addendum for all narcotic treatment program (NTP) registrations, indicating that the program would be subject to 21 U.S.C. Section
823 (f) and (g). All existing methadone programs would be required to sign this Addendum when submitting renewal applications.
- The DEA was given the authority for these Sections in 1984 when the Dangerous Drug Division Control Act was passed to amend the Controlled Substances
Act of 1970. Section (f) gave the U.S. Attorney General authority to deny an application for a narcotic treatment program if the Attorney General
determined that the issuance of the registration would be inconsistent with the public interest.
- DEA has indicated that they are requiring methadone treatment programs to sign this Addendum as a method of informing individual organizations
of this authority.
