Statutorily Required Reports

The Wisconsin Department of Health Services (DHS) is statutorily required to provide one-time, quarterly, annual, and biennial reports on behalf of the agency. DHS is required to provide these reports and information to the legislature and governor.

Birth to 3 Program State Performance Plan/Annual Performance Report, 2020

Wisconsin Stat. § 51.44(5)(c)

51.44(5)(c).  Annually, submit to the chief clerk of each house of the Legislature for distribution to the Legislature under s. 13.172(2) a report on the department's progress toward full implementation of the program under this section, including the progress of counties in implementing goals for participation in 5th-year requirements under 20 USC 1476.

Statewide Immunization Program 2021 Report

Wisconsin Stat. § 252.04(11)

Annually, by July 1, the department shall submit a report to the legislature under § 13.172(3) on the success of the statewide immunization program under this section.

Revised DHS Opioid Settlement Funds Proposal for SFY 2023

2021 Wisconsin Act 57

2021 Wisconsin Act 57 requires the Department of Health Services (DHS) to submit to the Joint Committee on Finance (JCF) by April 1 of each year a proposal for expending settlement proceeds paid to the state from the National Prescription Opiate Litigation (NPOL), Case No. MDL 2804. Per Act 57, 30 percent of the NPOL settlement proceeds will be allocated to DHS for purposes that comply with the settlement agreement or court order. DHS is required to submit a plan to JCF for spending settlement proceeds by April 1 of each year for the next fiscal year and requires JCF approval via the 14-day passive review process before it can expend the NPOL settlement funding. Approval is also required if DHS seeks to deviate from the proposed plan in the future. The remaining 70 percent of the settlement proceeds will be provided to local governments that were party to the litigation.

Wisconsin Diabetes Action Plan Report to the State Legislature

Wisconsin Stat. § 255.085

(1)  The department shall, in consultation with the department of employee trust funds, develop and implement a plan to reduce the incidence of diabetes in Wisconsin, improve diabetes care, and control complications associated with diabetes. The department may also consult with the department of public instruction and the department of corrections in developing a plan under this section.

(2) By January 1, 2021, and biennially thereafter, the department shall submit a report to the chief clerk of each house of the legislature for distribution to the legislature under § 13.172(2)

Tobacco Use Cessation: 2021 Annual Report to the Governor and the Legislature

Wisconsin Stat. § 255.15(4)

(4) Reports. Not later than April 15, 2002, and annually thereafter, the department shall submit to the governor and to the chief clerk of each house of the legislature for distribution under § 13.172 (2) a report that evaluates the success of the grant program under sub. (3). The report shall specify the number of grants awarded during the immediately preceding fiscal year and the purpose for which each grant was made. The report shall also specify donations and grants accepted by the department under sub. (5).

Opioid and Methamphetamine Treatment Programs Progress Report to Legislature: 2022 Report

2013 Wisconsin Act 195

By the first day of the 24th month beginning after the effective date of this subsection, April 8, 2014, and annually thereafter, the department shall submit to the joint committee on finance and to the appropriate standing committees under Wis. Stat. § 13.172(3) a progress report on the outcomes of the program under this section.

Section 1. 20.435(5)(bc) of the statutes is amended to read: Grants for community programs. The amounts in the schedule for grants for...opioid treatment programs under Wis. Stat. § 51.422.

Class A Violations for Nursing Homes and FDDS: 2020

Wisconsin Stat. § 50.04(5)(fr), Wis. Act. 237

As defined by s. 50.04(4)(b)(1), a Class A violation is “a violation of this subchapter or of the rules promulgated thereunder which creates a condition or occurrence relating to the operation and maintenance of a nursing home presenting a substantial probability that death or serious mental or physical harm to a resident will result therefrom.”

2021 Medicaid Dental Pilot Program Evaluation

Wisconsin Stat. § 2.49.45(24k)(c)

No later than January 1, 2020, and biennially thereafter, that the Department submit to JFC, the chief clerks’  offices and to the health or public benefits committees a report that identifies the number of MA members who received services under the pilot program, an estimate of the potential reduction in health care costs and ER visits due to the pilot program, the feasibility of continuing the pilot project and expanding in specific areas of the state or statewide, the amount of money distributed under the project and an explanation if not all funds were distributed, and an analysis of Medicaid member populations who received services under the pilot program and populations who were not enrolled but who may benefit from participation.

Report on Relocations and Diversions from Institutions - SFY 2019-2021

Wisconsin Stat. § 51.06(8)(b)

(a) In this subsection: 1. “Intermediate care facility for individuals with intellectual disabilities” has the meaning given in 42 USC 1396d (d). 2. “Medical assistance programs” has the meaning given in Wis. Stat. § 49.43 (8). 3. “Nursing home” has the meaning given in Wis. Stat. § 50.01(3). (b) Annually by October 1, the department shall submit to the joint committee on finance and to the appropriate standing committees of the legislature under Wis. Stat. § 13.172(3) a report that includes information collected from the previous fiscal year on the relocation or diversion of individuals who are Medical Assistance eligibles or recipients from nursing homes, intermediate care facilities for individuals with intellectual disabilities, and state centers for the developmentally disabled.

Wisconsin Hospital Assessment: SFY 2021

(7) By January 1 of each year the department shall report to the joint committee on finance all of the following information for the state fiscal year ending the previous June 30: (a) The amount each eligible hospital paid under sub. (2). (b) The amounts the department paid each health maintenance organization under s. 49.45 (59) (a). (c) The total amounts that each eligible hospital received from health maintenance organizations under s. 49.45 (59) (b). (d) The total amount of payment increases the department made, in connection with implementation of the hospital assessment under sub. (2), for inpatient and outpatient hospital services that are reimbursed on a fee−for−service basis.

Report on Rehabilitation Requests, 2021

Wisconsin Stat. § 50.065(5g)

(5g) Beginning on January 1, 1999, and annually thereafter, the department shall submit a report to the legislature under Wis. Stat. § 13.172 (2) that specifies the number of persons in the previous year who have requested to demonstrate to the department that they have been rehabilitated under sub. (5), the number of persons who successfully demonstrated that they have been rehabilitated under sub. (5) and the reasons for the success or failure of a person who has attempted to demonstrate that he or she has been rehabilitated.
